Reviewed sting-related legal outcome. Acquittal is explicitly reported; do not adopt the article's uncertain explanation of its legal basis. Saved arrest record is not the acquittal judgment; keep reported basis. Original four-page packet establishes named single-count allegations. Acquittals remain attributed to the reviewed reported trial account, not the initial-appearance order.
Case narrative
Biography
Moffitt was a forty-four-year-old Maintenance Engineer at the Boca Raton Resort.
Sting
Upon arriving, he is reticent to walk through the front door. Emily meets him at the door to try to coax him into the house, but Moffitt is apprehensive. He wants a better look at her, but Emily doesn’t move. He says she doesn’t act the same or look the same as in her online photos or sound the same, to which Emily replies that people act differently online but doesn’t have an answer for his other suspicions. They go back and forth for half an hour, with Moffitt asking Emily to show him some identification to prove that she’s real, like a piece of mail. Emily tries to go quid pro quo with him, telling him she’ll get her library card as long as he comes in and strips as promised. Moffitt tries to case the place while this is happening. When Emily returns without her library card, he asks where the nearest Walgreens is, to which she replies that the situation is “retarculous” and walks away. Moffitt attempts to go back to his car where he is apprehended by Ft Myers Police, proclaiming to them, “I didn’t do anything!” He was then arrested and charged with lewd and lascivious behavior with a child 12-15 years old.
Aftermath
Hansen found a number associated with Moffit and left a voicemail but did not hear back. Hansen stated this case highlights why some laws need change.
Trivia
Although Moffit was never convicted, some of his arrest and booking information is available for public view. Chris Hansen misrepresented Moffitt's intentions of asking where the Walgreens was as trying to abduct her. When, in reality, he was quizzing her on the stores in the area to see if she was real.
