Sentence · Oct 11, 2012
FDC lists a five-year term for each of the three listed offenses. Concurrency and an aggregate term are not stated.1
Recorded release · Nov 8, 2016
FDC inmate-release record explicitly lists this historical release after custody beginning October19,2012. It does not establish present custody or the legal release mechanism.1
Reviewed sting-related legal outcome. Saved3-page arrest/first-appearance file read; no sentencing judgment. September4,2009 is stated conviction date, not independently exact sentencing date. Later2016 probation-violation custody excluded. FDC directly contradicts the archive chronology: the later prison terms were imposed October 11, 2012, and release occurred November 8, 2016. Do not create a new 2016 offense from the community account. Basis for resentencing is not established by the agency history. Initial conduct charge may have become battery; no extra final count inferred.
Case narrative
Sting
Le visited the sting house on December 9, 2006. He was considerate enough to leave his shoes at the door and praised the sting house's interior decor, likening it to a high-end restaurant. When the decoy inquires if he brought condoms, he replies that he didn't bring them but offers to go get some. After that, Chris Hansen appears. After Chris inquired as to his purpose for being at the sting house, Le claimed that the girl invited him over "to say hi." Le continued to deny having any condoms when Chris asked if he had. Chris starts to seem sceptical as he says that he only offered to go buy some for the decoy. Le later acknowledged he might have had intercourse with the girl if she had wanted to. After Chris prompted him, he also acknowledged knowing it was illegal. Chris then makes it known that he was with NBC Dateline and they were doing a story on child sex predators. Remaining polite, Le extends his hand and gives Chris a handshake. Le apologizes and moves towards the door while putting his shoes back on. He exits the house and is arrested by the Flagler Beach police.
Police interrogation
During his police interrogation, Le stated that the girl was thirteen but then claimed to have seen on another page that she was 48-years-old. He then retracts that story and admits she was thirteen. The girl, according to Le, was the one who first made contact with him. He stated that they discussed school and that he "overdid himself" when discussing sexually explicit topics. He admitted to discussing "the upper part of the body," referring to her breasts. He attempted to claim he wasn't a good talker in person but was better online.
After the investigator asked what his plan was, Le stated that he had no idea what would happen when he arrived at the sting house. Le then goes on to say that he wanted to have sex with her but couldn't because he was scared, and that he didn't want her to laugh at him. He asserts he does not drink, smoke, or party and that all he does is work.
Trivia
Unlike his sting mates Safraz Khan and Daniel Peter Kelly , and most other foreign nationals featured on the show, Le was lucky enough to not be deported back to his native Vietnam following his conviction and even his 2016 rearrest.
