Case narrative

Confrontation with Chris Hansen

Upon arriving at the sting house, Lemke engaged in a conversation with Del Harvey , who, under the guise of a teenage boy, communicated with him from another room. The dialogue unfolded just before the entrance of Chris Hansen . Unwilling to take a seat, when asked what his plans were, Lemke insisted he was merely "hanging out." Lemke demanded Hansen to identify himself multiple times, and when Hansen asked for identity, Lemke introduced himself as "Kevin" while withholding his last name and expressing a desire to leave. When asked about why he was at the sting house, Lemke asserted that he had been "misled" and continued to persistently press Hansen to unveil his identity. This revelation prompted the exposure of the camera crew, compelling Lemke to make a hurried departure from the sting house, ultimately leading to his arrest by the Riverside police.

Aftermath

After his arrest, Lemke was originally charged with a felony count of attempted oral copulation with a minor under 14 years of age and another felony count of attempted harmful matter sent with intent of seduction of a minor. The court set his bail at $50,000. While out on bail, Lemke started to attend therapy sessions. On February 8, 2006, Lemke appeared in court and was arraigned. On March 8, 2006, Lemke later appeared in court for a felony settlement conference and was seen approaching and talking with fellow Riverside predators Paul Constantinescu and Nicholas Cocos , even shaking hands with Constantinescu.

In 2008, Ken Lewis and Barry Sands, the attorneys representing Lemke, asserted in an interview that they had attempted to negotiate a plea deal with the Riverside County district attorney's office ever since Lemke's arrest. However, their efforts were met with refusal, as the district attorney's office declined to engage in plea-bargaining for any of the men caught in the sting operation. Lewis elaborated that upon being denied a plea deal, they blamed the district attorney's office for dragging out Lemke's case for years, emphasizing that their only option was to proceed to trial. Lewis emphasized that a significant concern was that if Lemke were to be found guilty, he would be required to register as a sex offender. In 2009, he was found guilty and convicted on a felony count of attempted lewd or lascivious acts with a child under 14 years of age and a felony count of attempted harmful matter sent with intent of seduction of a minor. Lemke was sentenced to one year in jail and was required to register as a sex offender for the rest of his life.
