Case narrative

Sting and Arrest

Knowing the parents will be home, Chisholm devises a plan for the decoy to sneak out of the house to meet him. Despite this, when the day of the meet comes, Chisholm drives right up to the house to meet the girl (genuis move there). Casey comes out to meet him, tells him her parents went to the movies and they go to sit on the beach. Dwayne tries to get Casey to sit on his lap, which cues Chris Hansen to come out early. Opting not to use confrontational language due to Chisholm's large size, Chris very calmly berates him with no snide remarks or quips. For example, when asked how he would feel if someone did the same thing if he had nieces or nephews, Chisholm admits he couldn't be happy. In spite of his intimidating size, he gives a very candid and apologetic interview. He admits what he was doing was wrong, although he emphasises he wouldn't force the girl to do anything, with Chris reminding him that since the girl would have been a minor, whether she consents or not, it is still considered statutory rape.

When Chisholm is exposed, knowing the jig is up, he apologizes for his actions, saying he didn’t know how it came to this other than he works very hard and life is tough, although he admits this is less of an excuse and more of an unjustified reason. While he is preparing to leave, another suspect, Jean Erick Saintil , arrives at the stinghouse, honking his car horn several times to get the attention of what he believes to be a thirteen-year-old. When Saintil catches a glimpse of Chisholm being confronted, however, he takes off, only to be arrested moments later. Chisholm asks when he can expect to see himself on television, acknowledging he may need to find new work since a lot of people he knows will undoubtedly see him on the show. Chris tells Chisholm that they haven't figured out who's going to be featured yet, and Chisholm understands. As Chisholm attempts to get up and leave, he stumbles off his chair and falls in the sand. He is subsequently arrested by the Ocean County Police Department.

In 2008, Chisholm pled guilty to a lesser charge of Attempted to Endanger the Welfare of a Child, and was sentenced to six months in jail, one year of probation, and lifetime supervision and registration as a sex offender.

Trivia

Dwayne’s size was so intimidating to everyone that he had Casey scared he was going to “squeeze the guts out of [her]”. The police also gave him the softest takedown of all the men caught. Instead of shouting commands at him, the arresting officer said in a soothing voice, “Relax. No one’s going to hurt you.” Even Chris chose not to use confrontational language towards him, electing to save such talk until post-production. Would often be compared to WWE wrestler and MMA competitor Bobby Lashley. He would also allegedly be inappropriate by constantly getting a girl at the center to sit on his lap. The commenter (who claimed to be sixteen at the time Dwayne was exposed on television) described him as "a predator in plain sight," and was especially disappointed because he looked up to Dwayne prior to his arrest, and didn't understand many of the things he did at the center were wrong. Because Chisholm is a resident of New Jersey and is classified as a low risk his sex offender, his registration information is not publicly available. It was public for a time after his rearrest, but this has been removed.
