Five years in prison for the Flagler Beach case, concurrent with a separate seven-year Duval County term; later lifetime probation and registration are also described.51
Reviewed sting-related legal outcome. Do not add the separate seven-year Duval sentence or its three-year probation to the sting case. Lifetime probation timing and case ownership remain insufficiently clear for numeric structured promotion. Distinct from David Michael Wagner in Michigan. Saved affidavit is an arrest document, not sentencing proof.

Sentence · Mar 31, 2009
Reported seven-year Duval prison term followed by three-year probation; Flagler term was later ordered concurrent. Agency lists battery terms of seven years and witness intimidation of five years.41
Distinct offenses involving an actual minor after sting arrest, not another sting. Two agency battery rows have distinct offense dates but are not converted to two legal counts without judgment. Final lifetime supervision statement is not safely assigned to a specific later order. Registry status and historical release do not establish current custody.
Case narrative
Sting
It took David about an hour to drive to the sting house in Flagler Beach. After making small talk with the decoy, Chris Hansen came out and questions him. When David inquired about an open house, Chris responded hilariously that it was another kind of open house. David claimed he merely wanted to "meet a friend" when he came over to the house. When he tried to leave, Chris stopped him and told him to sit down again. David complied and answered more questions. David then maintained that he left his car lights on. David is halted by Chris, who revealed that he was aware of David's desire to drive the girl in his car. David promised to return and dashed out of the house. Before he could escape, he was arrested by police.
Since David chose his right to remain silent before even being taken into the interrogation room, no police interview is available unlike all the other predators caught in this sting.
Aftermath
He was arrested again in May of 2007 in Duval County for sex offenses against the real child. For the case involving the real child, David pleaded guilty to charges of lewd or lascivious battery, and tampering with a witness, victim, or informant. A charge of contributing to the delinquency of a minor was dropped. He was sentenced in March 2009 to seven years in prison, followed by three years of probation. In August 2009, David was then found guilty in the Flagler Beach case. He pleaded guilty to child exploitation, transmission of harmful material to a minor, and attempted lewd, lascivious battery sex with a victim 12-15 years old. He was sentenced to five years in prison to be served concurrently with the Duval sentence. After his release from prison, David was designated a sexual predator in Florida and received lifetime probation and lifetime sex offender registration. He later moved out of Florida to Tucson, Arizona. Shockingly, despite actually having sex with a minor, David was classed as a Tier I sex offender and did not have to have his registry details public in Arizona, as only Tier II and Tier III offenders have to have their information public.
