Case narrative
Biography
Smith has a lengthy and violent criminal history, consisting in part of Intimidation, Strangulation, and Making Terroristic Threats for which has been to prison for. Smith claimed that the prior violent crimes were him "defending" himself.
Sting
Smith had been communicating with a decoy posing as a fifteen-year-old-girl. Deputies arrested Smith and conducted their interview first before Chris Hansen was able to.
Smith told Chris that he felt uncomfortable talking to the decoy, believing that he was being "coerced" due to the fact that he thought he could get in trouble. Smith said that because the decoy never responded to him when he asked if it was a sting, he was coerced.
Smith told Chris that he had seen the show before, even naming "To Catch A Predator." He later asked if he was going to be on "To Catch a Predator" and said that he had watched the show "several times" for entertainment. Smith claimed that he only brought a condom because he always carried one around "in case." He also stated that he had other plans that very same night to have sex with another woman. He claimed that the only reason he came over to the house was to "mentor" the minor girl. He went on to say that he has many other friends of school-age that he regularly communicates with, mentors, and assists with bullying issues. Smith maintained that he did not intend to have sex with the decoy because he only described sex acts, but did not explicitly say that he wanted to preform those sex acts with the decoy specifically. He also maintained that he planned to cancel once arriving but did not do so over the text because he wanted to tell her the news in-person. At the conclusion of the interview, he shook Chris Hansen's hand, which Chris said no other alleged predator had done before him.
Aftermath
Smith was sentenced to one year in prison for the charge of Importuning, while the other was dismissed.
