Reviewed sting-related legal outcome. Saved document inspected: arrest/charging affidavit, not a sentencing order. No court-record upgrade. The later probation termination is not represented as a new sentence. Rendered affidavit initially labels the contact allegation attempted lewd conduct, while conviction registry labels battery and corrections explicitly says attempted battery. These are retained as stages of one contact allegation, not invented additional counts. The other four affidavit allegations have unknown dispositions. Early probation termination is not a new conviction.

Case narrative

Biography

He was raised in Orlando and lived in Longwood. He was single at the time of the sting and lived in an apartment with a friend. She was reportedly twenty-two at the time. Brian had no criminal record prior to being arrested and convicted in Flagler Beach.

Sting

On December 8th, 2006, Brian traveled an hour with marijuana from Orlando to Flagler Beach, Florida, making a pit break for condoms and Mountain Dew at a gas station. He talked with the decoy, with her only wearing a towel, and the decoy made small talk with Brian, seeming in a pretty good mood as they laughed together. The decoy asked if he brought anything. Brian told her he got the drink, clothes and condoms. The decoy then told Brian she had to change and he told her he was heading to his car to retrieve the things he brought.

Worried that Brian would return to his car and leave after having potential second thoughts, Chris Hansen emerged and confronted him before he could leave the sting house. Hansen then asked Brian what he was doing; Brian replied that he was just there meeting "Ally." Hansen then asked how old the girl he was trying to meet was, to which Brian very nervously claimed, "fifteen going on..." before claiming he wasn't sure if it was true. Hansen then pressed Brian, who denied the girl told him her age but acknowledged that her profile said she was indeed fourteen. Brian then told Chris what he brought with him.

Brian tried to defend himself and said that as he drove to the house, he had almost decided against going. Brian admitted discussing sex with the decoy and blamed her for inviting him. Brian maintained he lied about having intercourse with a fifteen-year-old girl and that he had never met anyone online who was underage. After being exposed on television, he quickly fled the house and was taken into custody.

Police Interview

Brian was brought to the police station and was later questioned by Detective Liz Williams and another female agent. The officers asked about the fifteen-year-old he admitted to having sex with, but Brian refused to admit it was true. He claimed that he had made the decision not to have sex with the child while driving over. Brian then said he didn't know her age and that she started the conversation, but the detectives did not seem to buy into it.

Brian was charged with three felonies; using a computer to have sex with a minor, attempted lewd and lascivious acts, and attempting to send harmful material to a child, as well as for possessing marijuana which the detectives had found on him.
